A Toronto crack cocaine dealer caught back in busi\u00adness three times over the course of 10 months man\u00adaged to con\u00advince a judge that he deserves some leni\u00adency because put\u00adting him behind bars would mean hard\u00adship for his nine chil\u00addren, but not because he\u2019s addicted to the drugs he was caught ped\u00addling.<\/p>\n\n\n\n

Lloyd Wil\u00adli\u00adams pleaded guilty in Ontario\u2019s Court of Justice to three counts of pos\u00adses\u00adsion of cocaine for the pur\u00adpose of traf\u00adfick\u00ading in what Justice Andr\u00e9 Cham\u00adber\u00adlain described as the \u201cdeeply troubled\u201d neigh\u00adbour\u00adhood sur\u00adround\u00ading the inter\u00adsec\u00adtion at Dun\u00addas and Sher\u00adbourne streets for arrests on March 3, 2024, Oct. 25, 2024, and Jan. 4, 2025.<\/p>\n\n\n\n

Wil\u00adli\u00adams, who was released after each arrest \u2014 twice on bail and a third time on the prom\u00adise he wear a GPS track\u00ading device \u2014 also pleaded guilty to one count of pos\u00adses\u00adsion of pro\u00adceeds of crime over $5,000, and two counts for under that amount, and fail\u00ading to com\u00adply with a release order on Feb. 15, 2025. [This miscreant and professional criminal and hyper-sexed breeder easily got bail at least three times for dealing in drugs. Canadian political prisoner Les Bory was kept in detention and refused bail merely for expressing his ideas on a podcast. Do evil things, especially if you’re a privileged minority and the system bends over backwards for you. Express “evil” ideas, especially if you’re White and the system hits you harshly.]<\/em><\/p>\n\n\n\n

The Crown recom\u00admen\u00added a six-and-a-half-year prison sen\u00adtence. Wil\u00adli\u00adams\u2019 law\u00adyer argued for two years less a day in jail.<\/p>\n\n\n\n

\u201cLloyd Wil\u00adli\u00adams has nine chil\u00addren in total: two stepchil\u00addren and seven bio\u00adlo\u00adgical,\u201d Cham\u00adber\u00adlain wrote in a recent decision. \u201cThe young\u00adest is just 10 months old.\u201d One is 22 months old, and another is three, said the judge.<\/p>\n\n\n\n

Wil\u00adli\u00adams also has nine year-old twins, two 10-year olds and a 16-year-old. One of his nine-year-olds is on the aut\u00adism spec\u00adtrum, Cham\u00adber\u00adlain said.<\/p>\n\n\n\n

\u201cHe states that he provides sup\u00adport as a father to his chil\u00addren and that any lengthy absence would have a sig\u00adni\u00adfic\u00adant impact on their health and well-being.\u201d<\/p>\n\n\n\n

Wil\u00adli\u00adams iden\u00adti\u00adfies as both Black and Mi\u2019kmaq. [Two privileged minority statuses. That should be good for a double discount.]<\/em>Though he couldn\u2019t prove the lat\u00adter, the judge was \u201csat\u00adis\u00adfied\u201d Wil\u00adli\u00adams \u201chas estab\u00adlished a con\u00adnec\u00adtion to Indi\u00adgen\u00adous ances\u00adtry.\u201d<\/p>\n\n\n\n

\u201cIt is not unusual for Indi\u00adgen\u00adous people who have struggled under the yoke of colo\u00adni\u00adal\u00adism in this coun\u00adtry and its intergen\u00ader\u00ada\u00adtional impact to have lost con\u00adnec\u00adtions to their roots and com\u00admunity,\u201d Cham\u00adber\u00adlain said.<\/p>\n\n\n\n

\u201cFur\u00adther, mark\u00aders of the effects of intergen\u00ader\u00ada\u00adtional trauma, includ\u00ading poverty, familial addic\u00adtion, struggles with edu\u00adca\u00adtion and men\u00adtal health, and over-rep\u00adres\u00adent\u00ada\u00adtion within the crim\u00adinal justice and child wel\u00adfare sys\u00adtem, are often present when Indi\u00adgen\u00adous iden\u00adtity is con\u00adfirmed.\u201d<\/p>\n\n\n\n

Wil\u00adli\u00adams \u201cdeserves con\u00adsid\u00ader\u00ada\u00adtion for the reduced moral blame\u00adwor\u00adthi\u00adness asso\u00adci\u00adated with these chal\u00adlenges,\u201d said the judge.<\/p>\n\n\n\n

Wil\u00adli\u00adams, 44, was dia\u00adgnosed with epi\u00adlepsy at the age of three and con\u00adtin\u00adues to have seizures, said the decision.<\/p>\n\n\n\n

His law\u00adyer argued \u201cthat, in addi\u00adtion to the sig\u00adni\u00adfic\u00adant mit\u00adig\u00adat\u00ading health and per\u00adsonal cir\u00adcum\u00adstances, there are two legal con\u00adsid\u00ader\u00ada\u00adtions that should mit\u00adig\u00adate his sen\u00adtence, bring\u00ading it down to an upper reform\u00adat\u00adory range, namely, the impact and harm a lengthy prison sen\u00adtence will have on his fam\u00adily, and secondly, that Mr. Wil\u00adli\u00adams is addicted to the very drugs he sells, and as an addict-traf\u00adficker, he is entitled to sig\u00adni\u00adfic\u00adant mit\u00adig\u00ada\u00adtion,\u201d said the decision, dated Jan. 23.<\/p>\n\n\n\n

Cham\u00adber\u00adlain sen\u00adtenced Wil\u00adli\u00adams, who already had a lengthy crim\u00adinal his\u00adtory, to four-and-a-half years in prison.<\/p>\n\n\n\n

\u201cMit\u00adig\u00ada\u00adtion for addict traf\u00adfick\u00aders applies to cases where addicts agree to pur\u00adchase a small amount of a street drug from their dealer on behalf of someone unknown to the dealer,\u201d said the judge.<\/p>\n\n\n\n

\u201cThey usu\u00adally ask for the money up front, get a good deal from their dealer, and then chip off a por\u00adtion of the drugs they have pur\u00adchased for their own per\u00adsonal use, as a means of feed\u00ading their addic\u00adtion,\u201d Cham\u00adber\u00adlain said.<\/p>\n\n\n\n

That\u2019s not the case with Wil\u00adli\u00adams, said the judge.<\/p>\n\n\n\n

\u201cI do not deny that he is addicted to cocaine and likely other sub\u00adstances as well. However, the amounts of drugs he had in his pos\u00adses\u00adsion on each of the three occa\u00adsions he was arres\u00adted were sub\u00adstan\u00adtial. In March 2024, it was just over one ounce; in Octo\u00adber 2024, over four ounces; and in Janu\u00adary 2024, close to two ounces. These amounts make him a mid-level traf\u00adficker. The pro\u00adceeds seized from him over those three events, totalling over $7,800, strongly sug\u00adgest that this endeav\u00adour is for profit.\u201d<\/p>\n\n\n\n

The judge did not con\u00adsider Wil\u00adli\u00adams\u2019 addic\u00adtion a mit\u00adig\u00adat\u00ading factor.<\/p>\n\n\n\n

\u201cWith respect to the pos\u00adi\u00adtion that I should con\u00adsider the impact of fur\u00adther incar\u00adcer\u00ada\u00adtion on his fam\u00adily, I agree I should con\u00adsider the facts before me in con\u00adsid\u00ader\u00ada\u00adtion of any sen\u00adtence,\u201d Cham\u00adber\u00adlain said.<\/p>\n\n\n\n

The courts have found that \u201cfam\u00adily sep\u00adar\u00ada\u00adtion con\u00adsequences may jus\u00adtify a sen\u00adtence adjust\u00adment \u2014 even a sig\u00adni\u00adfic\u00adant one \u2014 or a depar\u00adture from the range,\u201d said the judge.<\/p>\n\n\n\n

\u201cThis is true even for grave offences that require deterrence and denun\u00adci\u00adation.\u201d<\/p>\n\n\n\n

The judge accep\u00adted that some of Wil\u00adli\u00adams\u2019 \u201cchil\u00addren are infants or tod\u00addlers, and that any assist\u00adance must bene\u00adfit the mother who cares for them. However, I note that Lloyd Wil\u00adli\u00adams has already jeop\u00adard\u00adized his abil\u00adity to be with his chil\u00addren and provide sup\u00adport by his repeated re-offend\u00ading while on bail and strict house arrest con\u00addi\u00adtions, and finally by his house arrest with a surety.\u201d<\/p>\n\n\n\n

The judge also noted that in 2021 and 2024, Wil\u00adli\u00adams \u201cwas con\u00advicted of ser\u00adi\u00adous domestic assault charges, includ\u00ading assault by chok\u00ading. His troubled past rela\u00adtion\u00adship, which led to domestic assaults, sug\u00adgests a dimin\u00adished value in the sup\u00adport he provides to his chil\u00addren and fam\u00adily.\u201d<\/p>\n\n\n\n

The judge said he gave less con\u00adsid\u00ader\u00ada\u00adtion to Wil\u00adli\u00adams\u2019 \u201cclaim that his chil\u00addren and their mother will suf\u00adfer familial harm from his incar\u00adcer\u00ada\u00adtion, given his past and these crim\u00adinal acts.\u201d<\/p>\n\n\n\n

But Cham\u00adber\u00adlain said Wil\u00adli\u00adams \u201cis entitled to mit\u00adig\u00ada\u00adtion, to a greater or lesser extent, for these and the other mit\u00adig\u00adat\u00ading cir\u00adcum\u00adstances.<\/p>\n\n\n\n

\u201cI have already dis\u00admissed the fin\u00adan\u00adcial impact on his fam\u00adily because the court can\u00adnot con\u00addone the notion that the loss of pro\u00adceeds from a drug traf\u00adfick\u00ading enter\u00adprise can be con\u00adsidered mit\u00adig\u00adat\u00ading,\u201d Cham\u00adber\u00adlain said.<\/p>\n\n\n\n

\u201cBut I can\u00adnot dis\u00adcount what, at a min\u00adimum, is a fit sen\u00adtence in these cir\u00adcum\u00adstances, to a time-served sen\u00adtence, because of this unfor\u00adtu\u00adnate impact on the fam\u00adily.\u201d<\/p>\n\n\n\n

Cham\u00adber\u00adlain recog\u00adnized Wil\u00adli\u00adams\u2019 \u201cdecision to forgo his right to a trial on these mat\u00adters as sig\u00adni\u00adfic\u00adantly mit\u00adig\u00adat\u00ading, and he receives credit for that,\u201d said the decision.<\/p>\n","protected":false},"excerpt":{"rendered":"
